Terms and Conditions for Business Customers

These Terms and Conditions ("Terms") govern the purchase of leads and related services from Finfind, a brand of Your Remote CMO ApS ("Finfind," "we," "us," or "our"). By purchasing leads, you ("Buyer," "you," or "your") agree to be legally bound by these Terms.

1. Scope of Services

Finfind operates a lead generation and distribution platform. We collect consumer information and sell leads to business customers.

Finfind is not a credit repair organization, does not provide credit repair services, and does not guarantee any specific outcomes.

2. Definitions

Lead: A consumer record containing contact and qualification data collected by Finfind.

Delivered Lead: A Lead is considered delivered once made available to Buyer via CRM, dashboard, API, file transfer, email, or any other delivery method, regardless of Buyer acknowledgment or download.

Exclusive Lead: A Lead sold to Buyer on an exclusive basis for a period of 30 days from delivery. After 30 days, Finfind may resell or share the Lead with other buyers.

Shared Lead: A Lead that may be sold to multiple buyers at any time.

Invalid Phone Number: A telephone number that is disconnected, non working, clearly fake, or technically impossible to dial, including incorrect digit length or non existing area codes, as verified by Finfind.

3. Pricing and Payment Terms

All prices are agreed in writing before delivery. Prices are exclusive of VAT, sales tax, or other applicable taxes.

3.1 Payment Structure

Buyer may select either full upfront payment or a 50 percent upfront and 50 percent deferred payment structure.

If the 50 percent upfront and 50 percent deferred structure is selected, Buyer irrevocably agrees to pay the remaining 50 percent regardless of Lead performance, conversion rate, or Buyer satisfaction. Deferred payments are final, non negotiable, and not subject to dispute or withholding.

3.2 Automatic Billing and Stored Payment Method

Buyer authorizes Finfind to store Buyer’s payment method and automatically charge all amounts due via Stripe or other payment processors.

Buyer expressly waives any right to initiate chargebacks, disputes, or payment reversals and agrees to resolve any disputes directly with Finfind. Buyer acknowledges that unauthorized chargebacks constitute a material breach of these Terms.

3.3 Late Payments and Collections

Any overdue amounts shall accrue interest at the maximum rate permitted by law. Buyer agrees to reimburse Finfind for all reasonable collection costs, legal fees, and enforcement expenses.

4. No Refund Policy

All Lead purchases are final. No refunds, credits, cancellations, or offsets are provided for any reason, including but not limited to Lead quality, conversion rates, contact rates, or Buyer business results.

5. Lead Sharing, Exclusivity, and Resale

All Leads provided by Finfind are shared with multiple buyers.

Buyer acknowledges and agrees that Finfind retains full ownership of all Lead data and all associated intellectual property rights.

5A. Lead Delivery Timeline Guarantee

Finfind guarantees delivery of Leads according to the following schedule:

50 Leads will be delivered within 7 calendar days from the start date agreed in writing.

Delivery scales linearly, meaning 100 Leads will be delivered within 14 calendar days, 1,000 Leads within 140 calendar days, and so forth, unless otherwise agreed in writing.

This delivery timeline is the sole performance obligation of Finfind. Delays caused by force majeure, platform outages, advertising platform restrictions, regulatory changes, Buyer campaign pauses, or Buyer imposed constraints shall extend the delivery timeline accordingly.

Buyer acknowledges that this guarantee relates only to delivery volume and timing, not Lead quality, conversion, or business results.

6. Lead Replacement Policy

Finfind will replace Invalid Phone Numbers at no cost, provided Buyer submits evidence within 7 days of Lead delivery.

Only disconnected, non working, fake, or technically invalid numbers qualify as Invalid Phone Numbers. Leads with valid phone numbers that do not answer, decline services, provide inaccurate information, or are otherwise unresponsive are not considered invalid.

No other replacements, credits, or refunds are provided.

7. No Performance Guarantee and Lead Information Basis

Finfind does not guarantee Lead quality, accuracy, contact rates, conversion rates, revenue levels, or any business outcome.

All information provided about a Lead, including but not limited to revenue, budget, intent, company size, or qualification criteria, is based solely on the responses voluntarily provided by the Lead at the time of submission.

Any stated criteria, for example minimum $20,000 in revenue, reflects self-reported information from the Lead and is not verified or guaranteed by Finfind.

Buyer acknowledges that marketing and sales results vary and depend on Buyer’s processes, pricing, sales team, follow-up, and compliance.

8. Buyer Responsibilities and Compliance

Buyer is solely responsible for compliance with all applicable laws and regulations, including but not limited to TCPA, CAN SPAM, CROA, CCPA, CPRA, GDPR, and any state or federal telemarketing, consumer protection, and financial services laws.

Buyer represents and warrants that Buyer will obtain all required licenses, consents, and approvals and will handle consumer data lawfully.

Buyer assumes full responsibility and liability for all communications, marketing, sales practices, and data processing activities involving the Leads.

9. Disclaimer and Limitation of Liability

Finfind provides Leads on an "as is" and "as available" basis without warranties of any kind, express or implied.

To the maximum extent permitted by law, Finfind disclaims all liability for Buyer’s use of Leads, Buyer’s marketing practices, and any claims, damages, fines, penalties, regulatory actions, or legal proceedings arising from Buyer’s activities.

Finfind’s total liability under these Terms shall not exceed the total fees paid by Buyer in the preceding 30 days.

10. Indemnification

Buyer agrees to indemnify, defend, and hold harmless Finfind, its directors, officers, employees, contractors, and affiliates from any claims, damages, losses, fines, penalties, liabilities, costs, and expenses (including legal fees) arising from Buyer’s use of Leads, violation of laws, or breach of these Terms.

11. Intellectual Property

All Lead data, platform content, trademarks, and intellectual property remain the exclusive property of Finfind. Buyer receives a limited, non transferable, non sublicensable license to use Leads solely for Buyer’s internal business purposes.

12. Confidentiality

Buyer agrees to keep Lead data, pricing, and business terms confidential and not disclose them to third parties except as required for Buyer’s internal operations.

13. Non Circumvention and Non Solicitation

Buyer shall not attempt to identify, contact, or contract with Finfind’s traffic sources, publishers, vendors, employees, or partners for the purpose of circumventing Finfind. Buyer shall not solicit Finfind’s employees or contractors during the term of this agreement and for 12 months thereafter.

14. Term and Termination

These Terms apply to all Lead purchases unless terminated by Finfind. Finfind may suspend or terminate service at any time for breach, misuse, or non payment.

Termination does not relieve Buyer of any payment obligations.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Denmark, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the courts of Aarhus, Denmark, unless Finfind elects binding arbitration at its sole discretion.

Buyer agrees that Finfind may seek injunctive relief in any jurisdiction to protect its intellectual property and business interests.

16. Force Majeure

Finfind is not liable for delays or failures caused by events beyond reasonable control, including system failures, network outages, natural disasters, government actions, or third party service disruptions.

17. Entire Agreement

These Terms constitute the entire agreement between Finfind and Buyer regarding Lead purchases and supersede all prior agreements.

18. Amendments

Finfind may update these Terms at any time. Continued purchases constitute acceptance of updated Terms.
